Résumé: تحتوي هذه الورقة العلمية على دراسة تحليلية لمختلف الجرائم الانتخابية التي تحدث أثناء مرحلة التصويت و الفرز الانتخابي التي تأتي ما بعد المراحل التحضيرية في العملية الانتخابية، و اللتان تمثلان أهم مرحلتين في العملية الانتخابية نظرا لحساسيتهما و تأثيرهما في النتائج الانتخابية الحاسمة لمصير الشعوب، في المدة القصيرة المحددة لهما و الواجب ضبطها بعناية ، كما تشتمل هذه الدراسة التحليلية على كافة المعطيات القانونية حول كل جريمة على حدى ، و دراسة مدى تفعيل الحماية الجنائية التي قام بها المشرع إثر استحداث القانون المتعلق بتنظيم الانتخابات رقم 21-01 ، تزامنا مع إشراف السلطة الوطنية المستقلة للانتخابات على مختلف أنواع الانتخابات الرئاسية و بعدها التشريعية و بعدها المحلية إضافة إلى إشرافها على الاستفتاء الشعبي حول الدستور . This scientific paper contains an analytical study of the various electoral crimes that occur during the stage of voting and electoral counting that come after the preparatory stages in the electoral process, which represent the two most important stages in the electoral process due to their sensitivity and their impact on the decisive electoral results for the fate of peoples, in the short period specified and must be carefully controlled. This analytical study also includes all the legal data about each crime separately, and a study of the extent to which criminal protection was activated by the legislator following the introduction of Law No. 21-01 on the organization of elections, coinciding with the supervision of the Independent National Electoral Authority on the various types of presidential elections and their aftermath. The legislative and its local dimension, in addition to its supervision of the popular referendum on the constitution.
